Yes. eFiling is mandatory for all actions in the Supreme Court of Appeals and Intermediate Court of Appeals of West Virginia, unless an exception applies under the Rules of Appellate Procedure or by court order. Attorneys who are unable to eFile may request permission from the Court to file documents by paper for good cause.
eFiling is available for actions filed with the Supreme Court of Appeals and Intermediate Court of Appeals of West Virginia. Case types include appeals and other appellate matters handled by the courts, including civil, family, probate, juvenile, workers’ compensation, administrative, criminal, and original jurisdiction matters, as applicable to each court.

Attorneys and other authorized users who have completed the required registration and training may use the eFiling system. The system requires users to register and receive credentials before they can file, serve, or access case information.
Yes. The Rules of Appellate Procedure provide limited exceptions. For example, an attorney who is unable to use the eFiling system may request permission to file by paper for good cause. Documents that cannot be produced in an acceptable electronic format, such as certain audio recordings, videos, or large maps, may also need to be filed conventionally with the Clerk.
Yes. Self-represented parties may file electronically. Those who do not have access to eFiling may file paper documents with the Clerk, who will electronically file them upon receipt.

Documents filed through the eFiling system are generally served electronically through the system. A Notice of Electronic Filing is generated and emailed to the filing user and participating attorney users who have appeared in the action. Where required, an e-filed document may instead include a certificate of service in accordance with Rule 37.
The eFiling system generates an electronic filing receipt when a document is properly filed. The system also generates a Notice of Electronic Filing when a document is electronically filed. The electronic docket maintains filing receipts and associated case documents.
Rule 38A of the West Virginia Rules of Appellate Procedure governs electronic filing and service in the Supreme Court of Appeals and Intermediate Court of Appeals. The current Rules of Appellate Procedure are available through the West Virginia Judiciary.
